NB: translation for information purposes only. The French version of these general terms and conditions of sale is the governing version.
Article 1: Purpose
The company Rénier Sarl, which registered office is situated 11, avenue de La Motte-Picquet 75007 Paris, France, (RCS Paris 42877400400033, n° VAT: FR 77428774004) hereinafter referred to as « the Company», selling on the web site www.francoisrenierparis.com, hereinafter referred to as the « Site », a selection of items from the collections and the standards of the brand François Rénier Paris Un Jour Un Sac, hereinafter referred to as the « Products ».
The act of placing an order implies full and entire acceptance of these general terms and conditions of sale, which may be accessed at anytime on the Site, especially when registering an order. These general terms and conditions of sale may be modified at any time. The new general conditions of sale shall apply to any order placed after they have been posted on the Site.
Article 2: Access and conditions of order
The service offered by the Company is intended for the persons who are of age.
To access the service, the client shall go on the Site and fill a register form including the following information: name, first name, birth date, address, email.
To place an order the Client shall go through a process of selection, of validation and then of confirmation of payment.
Article 3: Prices - Invoicing
Prices are VAT included, indicated in Euro, excluding transportation costs.
Prices may be changed at any time, it being understood that the items shall be invoiced on the basis of the applicable at the time the order was placed.
Any change in the applicable VAT rate shall automatically affect the final price of the Product.
The price shall be payable by the Client according to the method of payment that will be available on the Site at the time of placing the order.
The overall price of the order is shown on the "Order review" screen (Finaliser ma commande), and includes in particular the following information:
- Price of the Product(s)
- Transportation costs
Article 4 : Delivery
The ordered goods shall be delivered at the address indicated by the Client within the time period shown on the Site, as soon as the payment is made and received by the Company.
The goods on sale are delivered only to metropolitan France, included Corsica;
However if a client non resident in metropolitan France wishes to place an order, he may contact the customer service in order to establish a distant buying process. Depending on the country of destination, an estimate will be drawn up for the transportation costs. The payment could be done from a distance by giving the credit card number, the validation date and the three numbers written on the back of said card.
If the Client did not receive the order within the deadline indicated when confirming the order, he shall have to contact the customer service by e-mail at: info@francoisrenierparis.com or by telephone at : 0033 1 47 53 77 03.
If the Client does not receive its order within 7 days following the indicated delivery date, for any other cause than a case of Force Majeure, the client shall have the possibility to cancel the sale by sending a registered letter with an acknowledgement of receipt request pursuant to the provisions of article L.121-20-3 of the French Consumer code (Code de la consommation).
The Client shall have this right within 60 working days from the expected date of delivery.
The Client shall then be reimbursed of the entire amounts paid given sums (including transportation costs paid at the time of the order for one or more of the concerned Products) within thirty (30) days from the date when the Client exercised his right to cancel the order.
On the day of receipt of its order, the Client shall check the conditions of the package, of the ordered goods and the compliance of the goods delivered with the order.
If the Client notices that the package or the article has been damaged, this has to be written on the delivery slip of the carrier and the Client has to contact immediately the customer service of the Company.
In any case, the Client has three days, excluding bank holidays, from the date of the delivery to file a complaint via registered letter or extrajudicial document without reservations (article L133-3 of the French Commercial code).
If the delivered goods do not comply with the order, the Client could send them back in accordance with the process set out in article 5 of these general terms and conditions of sale.
Article 5: Right of withdrawal and return
The Client has a fourteen (14) day time period from the date of receipt of the order to exercise its right of withdrawal, in the conditions set out in articles L.121-20 and seq. of the French Consumer Code. The costs for the return of the goods shall be born by the Client (art. L121-20 of the French Consumer Code).
The returned goods shall be complete and in their state of origin with the package, the copy of the invoice and the complete return form included.
Please note that items returned incomplete, ruined, damaged or soiled will not be taken back.
Article 6: Intellectual property
Subject to prosecutions, the Client is formally prohibited to copy, modify, divert, reproduce, represent as an illustration, pass on or distribute, in any way whatsoever, articles of the brand François Rénier Paris Un Jour un Sac.
The Client is informed that any unauthorised use of the elements constituting the Site (trademarks, models, copyrights, domain names…) could be considered as infringement and therefore subject to the provisions of the French Intellectual Property Code (Code de la Propriété Intellectuelle).
Article 7: Liability
The Company will do its best efforts to maintain the Site accessible at any time, however, for maintenance reasons, the Company reserves the right to suspend access to the Site without prior notice and this without giving right to Clients to ask for damages.
In addition, the liability of the Company could not be seek, in the following cases
- wrongful use of the services by the Client;
- Punctual disorders, Site interruptions, delays, absence or bad delivery of the content for reasons not imputable to the Company in particular in case of failure of telecommunication systems;
- Damages (in particular virus contamination due to third party malicious intrusion) which could affect the Client’s equipment;
- Discrepancies between the perception of the colours as set out on the screen used and as appearing in reality;
- Order placed by a minor with or without the consent of his parents;
- Case of Force Majeure
Article 8: Personal Data
As soon as the Client has placed an order on the Site, he could get some information on the new Products or special offers from the Company.
Pursuant to the law of January 6th 1978 as modified by the law of 6 August 2004, the Clients have a right of access, of rectification, of change or of deletion of their personal data upon request to the data process supervisor indicated in article 9.

Article 10: Applicable Law and jurisdiction
These general terms and conditions of sale shall be governed by and construed in accordance with French law without regard to the place of residence of the Client.
In the event of a dispute linked with the business relationship between the Client and the Company, the Court of Paris shall have exclusive jurisdiction.
